A man would like the court to preserve evidence that relates to an accident in which he was involved.
Jeffrey Newcomb filed a lawsuit Dec. 6 in Jefferson County District Court against Jacob Allen Birdwell.
Newcomb alleges he drove west in the 8100 block of FM 105 in Beaumont on Sept. 28, 2011, when Birdwell struck his vehicle.
Because of the collision, Newcomb experienced physical pain and mental anguish, sustained physical impairment, incurred medical costs and lost wages and his earning capacity, according to the complaint.
Birdwell negligently failed to keep a proper lookout, pulled onto another road when it was not safe to do so, failed to yield the right-of-way, failed to timely brake and failed to steer to avoid a collision, the suit states.
In addition to asking the court to preserve evidence, Newcomb would also like to see the defendants disclose various information, such as the correct names of the parties to the lawsuit and the amount of economic damages caused by the collision.
Newcomb is seeking actual damages within the jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.
