Contracting company failed to repay more than $50,000, according to suit

A financial company has filed suit against the Houston business that it claims failed to repay more than $50,000 to Wachovia Bank. 

Crest Finance claims it now owns a promissory note defendants Windsor Contracting and Ernestine Subia made with Wachovia Bank. The bank lent Windsor and Subia more than $50,000, according to the complaint filed Dec. 26 in Jefferson County District Court.

Since then, however, the defendants have failed to repay the money, the suit states.

“After the allowance of all just and lawful offsets, payments and credits to defendant, the balance of $50,660.13 on the note is past due and unpaid,” the complaint says.

In addition to the money it says it is owed, Crest Finance is seeking pre- and post-judgment interest, attorney’s fees, costs and other relief the court deems just.

Andrew C. Olivio of Carrollton will be representing it.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
