A final judgment has been entered in litigation brought by Orange resident Shawn Dickerson, who claims he swallowed a metal object while dining at Cafe Del Rio.
As previously reported, Dickerson filed suit against the restaurant’s owners, Great Texas Foods Corp., on April 18 in Jefferson County District Court, alleging the object caused him injury.
Judge Gary Sanderson, 6oth District Court, signed off on a final judgment in the case on Sept. 11, court records show.
The judgment states that the parties announced to the court that all matters in controversy had been compromised and settled and that Dickerson take nothing in accordance with such compromise settlement agreement.
The lawsuit alleges that on June 3 Dickerson was dining at Cafe Del Rio when ingested a metal object while eating his meal.
The suit does not describe the size or nature of the alleged metal object.
Dickerson claims the restaurant was negligent in its food preparation and owed him a duty to prepare food in a safe and sanitary environment.
He was suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages, plus all court costs.
