A Beaumont woman claims she has been worrying so much about the flood problems in her new home that she is suffering from migraines, and alleges the previous owners intentionally concealed the problems from her. 

Plaintiff Sandi S. Frank claims she bought a home in the 1400 block of Central Drive in Beaumont from defendants Daniel and Piper Garbarino for $176,705.

According to the suit filed in Jefferson County District Court, at the time of the sale the Garbarinos told Frank that there was no pump on the property and no flooding or drainage issues.

However, after buying the property, Frank claims the defendants were aware of flooding and drainage problems on the property and had attempted to conceal the issues, the suit states.

“In the sale of the property, the defendants knowingly engaged in an unconscionable action or course of action by pumping out water during rains to make it appear as if there was not a flooding/drainage problem and removing the pump during any inspections by plaintiff,” the complaint alleges.

To rectify the problem, Frank states she will have to pay $74,699.

Since learning of the issues with her property, Frank claims she has suffered from mental anguish and endured migraines, an allergic reaction and lost sleep, according to the complaint.

Frank is seeking economic and mental anguish damages, plus pre- and post-judgment interest, attorney’s fees, costs and other relief the court deems just.
