Kilgore woman sues following wreck in Marshall

MARSHALL - A Kilgore woman has filed a lawsuit claiming she suffered injuries caused by a motor vehicle wreck in Marshall. 

Jeanne Beick filed suit against Dale W. Graves on Feb. 6 in the Eastern District of Texas, Marshall Division.

The accident occurred on April 5, 2011, on Highway 59 in Marshall when Beick was in a collision with defendant Graves.

The defendant is accused of negligence for failing to keep a proper lookout, failing to control speed, failing to make a timely application of his brakes, failing to take proper evasive action, and for failing to maintain an assured clear distance between vehicles.

The plaintiff is asking for an award of more than $75,000 in damages for medical care and expenses, physical pain and suffering, mental anguish, physical impairment, loss of wage earning capacity, interest and court costs.

Beick is represented by J.R. Rusty Phenix of Phenix Phenix & Crump in Henderson. A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
