A lending institution has filed suit against the Beaumont woman who it claims failed to repay the more than $9,000 she owes on her vehicle.
Santander Consumer USA claims it financed a 2005 GMC Yukon for defendant Brenda Hendrix on Oct. 8, 2007. Since then, however, Hendrix defaulted on her loan payment, according to the complaint filed Feb. 8 in Jefferson County District Court.
“After all just and lawful offsets, credits and payments, as of Sept. 26, 2012, the balance past due and owing under the contract is $9,035.83,” the suit states. “Plaintiff has attempted to repossess the collateral, but these efforts have failed.”
In its complaint, Santander is seeking a judgment for possession of the collateral, plus pre- and post-judgment interest at the legal rate, attorney’s fees, costs and other relief the court deems just.
Aaron Z. Tobin and S. Cortney Sedighi of Anderson Tobin in Dallas will be representing it.
The case has been assigned to Judge Bob Wortham, 58th District Court.
