Driver says intoxicated driver to blame for multi-car collision

A man has filed suit against the driver who he claims rear-ended the vehicle behind him, causing a multi-car collision. 

Devin Woods claims he was stopped in the turning lane on Gulfway Drive in Port Arthur on March 4, 2011, when defendant Joseph Ryals struck the car behind Woods, “driving that vehicle violently into plaintiff’s vehicle, causing the collision and injuries complained of herein.”

Because of the collision, Woods suffered neck and back injuries, incurred medical costs, experienced physical pain and suffering and endured physical impairment, according to the complaint filed Feb. 7 in Jefferson County District Court. He also lost earnings, lost his earning capacity and suffered disfigurement and mental anguish, the suit states.

Ryals negligently failed to keep a proper lookout, failed to turn to the left or right to avoid a collision, failed to apply his brakes and drove while intoxicated, the complaint says.

In his complaint, Woods is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus exemplary damages, pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

He will be represented by Brett S. Thomas of Roebuck and Thomas in Beaumont.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
