Contractor abandoned work after collecting more than $50K, suit says

Two Jefferson County residents claim a contractor failed to complete repairs on their home, leaving them without finishing touches, such as flooring and granite countertops.

Shirley and James Payne filed a lawsuit March 15 in Jefferson County District Court against Moises Castillo. 

In their complaint, the Paynes allege they hired Castillo to complete alterations at their home on Pine Street in Port Arthur. However, after the Paynes paid Castillo $56,500, he abandoned them without completing work for them, according to the complaint.

The suit alleges that defendant Castillo:

Failed to complete the flooring in the master bedroom;

Failed to make repairs to the shower;

Failed to install a granite countertop in the master bathroom;

Failed to reinforce the structure with a cross beam in the family room;

Failed to re-cap the existing cabinets;

Failed to install a new granite countertop in the kitchen;

Failed to build a bar to separate the family room and the kitchen;

Failed to add a pantry to the laundry room; and

Failed to install wood or tile flooring in the kitchen.

In order to complete the work, the Paynes claim they will have to pay another contractor more than $75,000.

They say Castillo violated the Deceptive Trade Practices Act and breached his warranty.

In their complaint, the Paynes seek a judgment of more than $75,000, plus economic and mental anguish damages, pre- and post-judgment interest, attorney’s fees, costs and other relief the court deems just.
