Before a jury could be selected, a Port Arthur man’s suit, which alleged a driver side-swiped his vehicle, settled.
As previously reported, Abraham Mayorga filed a lawsuit March 17, 2011, in Jefferson County District Court against Eugene Martin.
Two years later, the case was slated to go to trial on Monday, March 25. However, the case settled before a jury could be selected, a court official told the Record.
In his suit, Mayorga claims he drove on W. Port Arthur Road on Nov. 2, 2009, when he came to a stop. Suddenly, Martin, who drove on the same road, slammed into the side of Mayorga’s vehicle.
Because of the collision, Mayorga incurred medical costs, lost earnings and his earning capacity and experienced physical impairment, physical pain and mental anguish, the suit states. In addition, he endured property damages, the complaint says.
Mayorga alleges negligence against Martin, saying he caused the collision.
Mayorga was seeking an unspecified judgment, plus interest, costs and other relief the court deems just.
