Discovery proceeding in scaffold injury case

Brand Energy recently filed a certificate of discovery in litigation brought by Beaumont local Patrick Tyler, who sued for injuries he allegedly received when his leg went through a scaffold.

As previously reported, Tyler’s suit was filed Jan. 12, 2012 in Jefferson County District Court and also names Brand Energy Solutions, Brand Scaffold Services and Atlantic Scaffolding as defendants.

Court records show that the certificate was filed March 26, and shows that Brand Energy’s requests for production, admissions, disclosures and interrogatories were served to the plaintiff.

The lawsuit states that on June 4, 2010, Tyler, an Industrial Process Insulation employee, was working at a Port Arthur plant when his leg fell through a portion of an above ground scaffold surface, causing him serious personal injuries.

Tyler alleges the surface of the scaffold was not properly secured and that the defendants negligently failed to erect and maintain the scaffold.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
