Leaky roof results in slip and fall against Wal-Mart

Port Neches local Kandy Clark is suing Wal-Mart Stores Texas, alleging she slipped and fell in a puddle of water leaking from the roof.

The suit was filed March 27 in Jefferson County District Court.

According to the lawsuit, on May 7, 2012, Clark was at the Port Arthur Wal-Mart when she slipped in a puddle of water.

“The water appeared to be leaking from the roof and there were no warning signs in the area,” the suit states.

The suit alleges Wal-Mart owed the general public a duty to warn and safeguard them from dangerous conditions on its premises.

The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.

Attorney Tom Oxford of the Beaumont law firm Waldman Smallwood represents her.

Judge Bob Wortham, 58th District Court, is assigned to the case.
