Beaumont man failed to make payments on Mercedes-Benz, court documents say

A Texas corporation has filed suit against the Beaumont man who it claims failed to timely make all of his payments on a 2011 Mercedes-Benz. 

Santander Consumer USA claims it inherited the interest in a contract Fifth Third Bank made with defendant Ronnie Taylor. In Fifth Third’s agreement, it financed the purchase of a 2011 Mercedes-Benz Taylor purchased from Mike Smith Nissan in Beaumont on May 10, 2012, according to the complaint filed April 12 in Jefferson County District Court.

Since then, Taylor has defaulted on his required monthly payments, the suit states.

“After all just and lawful offsets, credits, and payments, as of April 2, 2013, the balance past due and owing under the contract is $42,373.99,” the complaint says.

Santander is now asking the court for permission to repossess the vehicle. It also seeks a foreclosure on the vehicle, a court order that sheriff or constable seize the vehicle and deliver it to Santander and other relief the court deems just.

Aaron Z. Tobin, Kendal B. Reed and Julie C. Tower of Anderson Tobin in Dallas will be representing it.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
