Auto collision suit settles before trial

A few days before the case was set to go to trial, an automobile collision lawsuit settled.

Court records show that Carl Hidalgo filed suit against Emmett Ellis on May 6, 2011, in Jefferson County District Court, alleging Ellis negligently failed to keep a proper lookout and caused an automobile collision. 

The case was set to go to trial May 6. However, a courthouse official informed the Record the parties called the week prior announcing a settlement had been reached.

According to the lawsuit, the collision occurred on Feb. 4, 2010.

The original petition does not state where or how the incident occurred, only that Ellis’ alleged negligence caused the collision by failing to yield at an intersection.

Hidalgo was suing for his alleged past and future medical expenses, mental anguish, pain and lost wages.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
