Bank claims Nederland residents defaulted on loan

A bank has filed suit against the Nederland residents who it claims failed to repay a loan originally worth nearly $100,000.

Compass Bank claims its predecessor, Texas State Bank, lent defendants Scuba Brothers, Allen Acord and Anne Acord $95,000 on April 1, 2008.

Since then, however, the defendants have defaulted on the loan, according to the complaint filed May 1 in Jefferson County District Court.

“After all payments and credits are allowed, there is past due and owing under the note the amount of $32,790.55, including principal, accrued interest through December 7, 2012, late fees and expenses as provided in the note,” the suit states.

In addition to the money it claims it is owed, Compass Bank is seeking post-judgment interest at the maximum rate allowed by law, attorney’s fees, costs and other relief the court deems just.

William P. Huttenbach and Aaron E. Homer of Hirsch & Westheimer in Houston will be representing it.

The suit has been assigned to Judge Gary Wortham, 60th District Court.
