A woman claims she suffered neck and back injuries after a driver made a lane change when it was not safe to do so and collided with her vehicle.
Leslie B. Fesco filed a lawsuit May 7 in Jefferson County District Court against Erika Renee Melbert.
In her complaint, Fesco alleges she drove east in the outside lane in the 4500 block of College Street in Beaumont on March 19, 2012, when traffic slowed because of a truck and trailer turning into a private drive. Melbert was also driving in the outside lane, but suddenly swerved to avoid a collision. In the process, she struck Fesco’s vehicle, according to the complaint.
In addition to her injuries, Fesco incurred medical costs, experienced physical pain and suffering and endured mental anguish, the suit states.
Melbert negligently failed to keep a proper lookout, failed to take evasive action to avoid the collision, failed to yield the right-of-way, failed to apply her brakes in a timely manner and made a lane change when it was not safe to do so, the complaint says.
In her complaint, Fesco seeks damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.
