Litigation brought by Terry Daigle, who sued Shaw Maintenance for injuries after a filter basket fell on him, has been removed to federal court.
As previously reported, the suit was filed July 17 in Jefferson County District Court.
The notice of removal was filed Nov. 1, court papers show.
The case has been transferred to U.S. District Court for the Eastern District of Texas, Beaumont Division.
The lawsuit alleges that on Sept. 13, 2011, Daigle, a Goodyear employee in the course of his employment, was lifting a wheatly (filter) basket with a hoist when the trolley hanging the hoist fell off a monorail, causing the equipment to fall on him.
Allegedly, Shaw had removed part of the monorail without notifying Goodyear and its employees.
The suit alleges the defendant negligently failed to tag out an inoperable piece of equipment.
Daigle is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Judge Donald Floyd, 172nd District Court, was assigned to the case.
