Litigation brought by Port Arthur resident Willie LaDay III, who sued Maribel and Said Nechar for injuries received when the vehicle in which he was a passenger crashed into a house, has been stayed.
As previously reported, the petition was filed July 11, 2012, in Jefferson County District Court.
Court records show that on May 1 a notice of automatic stay of proceeding was filed, stating that the defendants’ insurer, Santa Fe Auto Insurance, was declared insolvent.
The case has been stayed for six months.
The lawsuit alleges that on July 9, 2010, LaDay was a passenger in a vehicle driven by Said and owned by Maribel. Said was traveling on Gulfway Drive in Port Arthur when he swerved and left the roadway, causing the vehicle to crash into a house.
The suit accuses Said of negligently failing to control his speed and keep a proper lookout.
LaDay is suing for actual damages, plus all court costs.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
