A Jefferson County man filed court documents saying that a car crash irritated a pre-existing condition, causing it to become painful and disabling.
Steven Todd Griffin filed a lawsuit May 20 in Jefferson County District Court against Russell Phend and Luis Munoz-Rios.
In his complaint, Griffin alleges he and Phend were involved in a collision on May 10 after Phend failed to control his speed and struck Griffin’s vehicle.
Because of the collision, Griffin’s pre-existing condition was aggravated, resulting in pain and disability, according to the complaint. He also incurred medical costs, experienced pain and suffering, endured mental anguish, lost his enjoyment of life, lost wages and suffered disfigurement, the suit states. The suit does not state what type of injuries he sustained or what type of pre-existing condition he has.
He blames Phend for causing the collision, saying he negligently failed to maintain a proper lookout, failed to timely apply his brakes, failed to yield, failed to keep a proper distance, failed to turn to the right or left to avoid a collision and failed to sound his horn.
In his complaint, Griffin seeks an unspecified judgment, plus interest at the maximum legal rate, costs and other relief the court deems just.
