Jefferson County women sued for alleged failure to repay student loans

The National Collegiate Student Loan Trust has filed two suits against two Jefferson County women who it claims failed to repay the more than $30,000 in student loans they each borrowed. 

The trust alleges defendant Kelly Morrow borrowed two loans to pay for her schooling, but has refused to repay them, according to the complaint filed in Jefferson County District Court.

“The loans are in default and all amounts owing thereunder have now become due,” the suit states. “As of the date of plaintiff’s original petition, $40,219.20 remained due and owing on the loans.”

The National Collegiate Student Loan Trust also filed a lawsuit against Ashley Spears, who borrowed $37,160.58 but also allegedly failed to repay the money. In addition to the principal balance, Ashley Spears owes the National Collegiate Student Loan Trust interest of $4,377.74, the complaint says.

In addition to Kelly Morrow and Ashley Spears, the National Collegiate Student Loan Trust has named Timothy Morrow and Alex Spears as defendants. The men guaranteed repayment of the loan, but have also refused to make any of the required monthly payments, the complaint says.

The National Collegiate Student Loan Trust alleges breach of contract against Kelly Morrow and Ashley Spears.

In addition to the money it claims it is owed, the National Collegiate Student Loan Trust seeks pre-judgment interest, attorney’s fees of at least $8,000, costs, post-judgment interest and other relief the court deems just.

Michael J. Scott of Carrollton will be representing it in both lawsuits.

Kelly Morrow’s case has been assigned to Judge Gary Sanderson, 60th District Court.

Ashley Spears’s case has been assigned to Judge Milton Shuffield, 136th District Court.
