Eugene Frantz is suing Kansas City Southern Railway for injuries he suffered when a work van in which he was riding was involved in an automobile collision.
Seeking more then $500,000 in damages, the suit was filed June 7 in Jefferson County District Court and also names Professional Transportation Inc., Hector Aguirre and Juan Torres as defendants.
According to the lawsuit, on April 24 Aguirre negligently crashed Torres’ truck into a vehicle, causing that car to crash into a PTI van in which Frantz was riding in.
The driver of the van was acting in the course and scope of his employment with PTI and KCSR, the suit states.
The suit faults Aguirre for negligently failing to maintain a proper lookout and following a vehicle to closely, while Torres is faulted with negligent entrustment.
PTI and KCSR are blamed for failing to proper safety equipment and a crashworthy vehicle.
The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.
