As the train he was riding in rolled backwards, Alan Goss Jr.'s leg and foot struck a vehicle operated by Tiffany and Lawrence Dixon.
On June 12 Goss filed suit against the Dixons in Jefferson County District Court, alleging the defendants were “fouling the railroad tracks.”
According to the lawsuit, on Dec. 30, 2012, a vehicle operated by the defendants were stopped on railroad tracks in Beaumont
At the time, Goss, BNSF Railway employee, was riding on the rear car of a train.
“As the train proceeded backwards, plaintiff’s leg and foot struck defendants’ vehicle, causing serious injuries,” the suit states.
The suit further accuses the defendants of negligently failing to keep a proper lookout and failing to warn the train crew the vehicle was parked too close to the railroad tracks.
The plaintiff is suing for his alleged past and future mental anguish, pain, impairment and lost wages.
