Two Beaumont residents have dismissed the installer of a cabinet, which allegedly became unhinged and fell on them, from their lawsuit.
As previously reported, Nick Valis and Caesonia Allen filed suit against Commercial Woodcraft, doing business as Milltech, on April 18, 2012, in Jefferson County District Court.
Court records show that an agreed order of dismissal was entered on Jan. 29, stating that the plaintiffs’ claims against the defendant are hereby dismissed with prejudice.
The lawsuit alleged that on March 3, 2011, the plaintiffs were in the course and scope of their employment at a local hospital.
When Valis opened a cabinet door that had been installed by Milltech, the cabinet fell on top of him, the suit claims.
Allen attempted to hold the cabinet off of Valis until help arrived. Both were injured in the process, the suit alleges.
The suit states that Milltech negligently installed the cabinet and failed to properly secure it to the wall.
The plaintiffs were suing for their alleged past and future medical expenses, mental anguish, pain, impairment and lost wages, plus all court costs.
Attorney Tom Oxford of the Beaumont law firm Waldman Smallwood represented them.
Judge Gary Sanderson, 6oth District Court, was assigned to the case.
