Insurance company dismissed from Hurricane Ike suit

An insurance company has been dismissed from a Hurricane Ike suit that alleged the insurer did not fully compensate the plaintiff following the storm.

Last May, Bobbie Jean Thomas filed a lawsuit against National Security Fire and Casualty Co. in Jefferson County District Court.

Court records show that on Nov. 30 Thomas filed a motion to dismiss, stating the parties had compromised and settled the matter.

That same day, Judge Donald Floyd, 172nd District Court, granted the motion, dismissing National Security Fire with prejudice.

In her suit, Thomas alleged National Security Fire and Casualty denied her claim for damages caused to her property on Maple Avenue in Port Arthur after Hurricane Ike struck on Sept. 13, 2008.

She accused the company of breach of contract and violating insurance code regulations.

Thomas was suing for actual and consequential damages.

She was represented by Clint Brasher and Joe Muckleroy of Beaumont.
