A mortgage company is asking the court for the ability to retain possession of a manufactured home after the home’s occupant defaulted on his payments.
21st Mortgage Corp. filed a lawsuit June 19 in Jefferson County District Court against Jason Wellons.
In its complaint, 21st Mortgage alleges it lent Wellons money toward the purchase of a 1997 Crest Ridge manufactured home. In turn, 21st Mortgage held a security interest on the home, according to the complaint.
Since then, Wellons defaulted on his payments, the suit states.
Now, 21st Mortgage seeks possession of its collateral, plus any additional money Wellons owes after the property has been collected.
“In the alternative and without waiving the foregoing, 21st Mortgage seeks payment in the amount of $26,629.23 with interest accruing pursuant to the terms and conditions of the contract,” the complaint says.
In addition, 21st Mortgage Corp. seeks attorney’s fees and other relief the court deems just.
Natalie D. Paul of Johnson & Silver in Dallas will be representing it.
Judge Milton Shuffield, 136th District Court, has been assigned to the case.
