Toyota Motor Sales has settled a suit filed by Nederland residents Larry and Kathleen Delcambre, who sued the company alleging they were sold a lemon.
As previously reported, the suit was filed April 25, 2012, in Jefferson County District Court.
Court records show the parties filed an agreed motion to dismiss on Jan. 23, stating the case was settled.
On Feb. 7 Judge Bob Wortham, 58th District Court, dismissed Toyota with prejudice.
The lawsuit alleged that on Sept. 18, 2010, the couple purchased a 2011 Toyota Camry manufactured and warranted by the defendant for $23,299.
The plaintiffs claimed the vehicle experienced transmission problems, engine whining and knocking.
The defendant’s ineffective repair attempts prompted the plaintiffs to make several requests for a refund, which were denied, the suit states.
The plaintiffs alleged the defendant violated the Deceptive Trade Practices Act by manufacturing and distributing a defective vehicle.
They were suing for more than $60,000 in damages, plus all court costs.
