As subrogee of Eastern Fishing & Rental Tool, St. Paul Fire and Marine Insurance has filed suit against Jefferson County, seeking to recover benefits paid to it’s insured following an automobile crash.
The suit was filed July 1 in Jefferson County District Court.
According to the lawsuit, on July 6, 2011, Wilber Carouthers was operating a Eastern Fishing vehicle and traveling west on State Highway 73 in Chambers County when a county employee ran a stop sign directly in front of him.
Carouthers took evasive action to avoid a collision and in doing so left the roadway and ran into a ditch, causing extensive damage to the vehicle.
The suit accuses the county employee of negligently failing to keep a proper lookout and yield the right of way.
St. Paul was paid $17,851.69 in damages following the collision.
It is suing for actual damages.
Sugar Land attorney Jeffrey Reddall represents it.
Judge Gary Sanderson, 60th District Court, is assigned to the case.
