Area residents Linda and Thomas Tidwell have filed suit against 101 First Avenue LLC, alleging that an uneven sidewalk caused Linda to trip and fall.
The suit was filed June 12 in Jefferson County District Court.
According to the lawsuit, on April 5, 2012, the Tidwells were visiting friends at the defendant’s Nederland apartment complex.
While walking on a sidewalk, Linda tripped over an uneven surface, twisting her ankle and splitting her femur.
The uneven surface was difficult to perceive, the suit states.
The suit accuses the defendant of negligently failing to maintain the premises and warn of the dangerous condition.
Linda is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus court costs.
Her husband is suing for loss of consortium.
Orange attorney Christopher Smith of Bush Lewis represents them.
Judge Bob Wortham, 58th District Court, is assigned to the case.
