A Texas man says that his insurance company failed to adequately compensate him after wind destroyed the roof of his trailer, causing water damages.
Chad Scott filed a lawsuit July 5 in Jefferson County District Court against State Auto Property and Casualty Insurance Co. and Karyn Bartels.
In his complaint, Scott alleges he was driving his vehicle in Jefferson County with his 2007 Keystone fifth wheel trailer attached to it on June 8, 2012. Suddenly and unexpectedly, Scott encountered high winds that damaged the roof of his trailer, according to the complaint.
At the time, Scott had an insurance policy through State Auto. He elected to file a claim with the insurance company on Feb. 20, 2013, requesting that they pay his insurance policy limits, the suit states.
However, Scott has not received a proper response to his claim, the complaint says.
Scott says the defendants, including State Auto’s adjuster, Karyn Bartels, have intentionally breached their contract with him, violated the Texas Insurance Code and breached their common law duty of good faith and fair dealing.
“Accordingly, these defendants are liable to plaintiffs for all actual damages, as well as all statutory damages enumerated in the Texas Deceptive Trade Practices Act and the Texas Insurance Code including but not limited to $541,060,” the suit states.
In his complaint, Scott seeks an unspecified judgment, plus pre- and post-judgment interest, costs and other relief the court deems just.
