Med-mal trial to focus on doc’s alleged botched surgery

A medical malpractice trial this week will center on a woman’s claim that her doctor somehow botched her surgery.

As previously reported, Lisa Moseley filed suit against Dr. Darioush Kavouspour and Surgical Critical Care Associates on Feb. 1, 2011, in Jefferson County District Court.

Jury selection in the case is set for Tuesday, July 23 in Judge Milton Shuffield’s 136th District Court.

According to the original petition, on Oct. 6, 2009, Dr. Kavouspour operated on Moseley at St. Elizabeth Christus Hospital in Beaumont.

However, the suit does not state what operation he preformed or why she had been admitted. The suit only says that when the case is tried the evidence will show “Moseley continues to suffer as a result of medical negligence.”

Moseley is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.

Houston attorney Craig Lewis represents her.

The defendants are represented by Houston attorney Frank Luccia of Luccia & Evans.
