Nederland Glass, who was sued by Kevin Armstrong after he tripped over some wood while installing a window, has filed a notice of bankruptcy.
As previously reported, the suit was filed Feb. 22, 2012, in Jefferson County District Court.
The defendant filed the notice was for Chapter 7 Bankruptcy on May 31, court records show.
The petition alleges that on Jan. 11, 2012, Armstrong, while in the course and scope of his employment with Nederland Glass, was installing glass at a Beaumont Wells Fargo bank. He was standing on a 3-foot high ledge when a coworker placed some blocks of wood behind him.
“When he stepped off of the ledge he stepped on the blocks resulting in the injuries and damages made the basis of this suit,” the suit states.
The suit alleges the defendant owed Armstrong a duty to safeguard him from unreasonably dangerous conditions and warn of their existence.
Armstrong is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Attorney Tom Oxford of the Beaumont law firm Waldman Smallwood represents him.
Judge Milton Shuffield, 136th District Court, is assigned to the case.
