Wal-Mart employee told plaintiff to ‘go ahead and sue’ after slip and fall, suit claims

After a Wal-Mart employee told her to “go ahead and sue” following a slip and fall at a local store, Jennifer Atkins went ahead and did just that.

Atkins filed suit against the mega retailer on July 19 in Jefferson County District Court. 

According to the lawsuit, on Aug. 17, 2012, Atkins was shopping at the Beaumont Wal-Mart when she was seriously injured as a result of a liquid substance spilled on the floor.

Following the incident, Atkins requested to view video surveillance of the fall and was instructed by the defendant to “‘go ahead and sue us if you want to watch the video and request it during discovery,’” the suit states.

“Plaintiff was left with no option but to bring this action in order to view the video footage of the incident.”

The suit accuses the defendant of negligently failing to allow the floor to become slippery and failing to warn of the danger.

The plaintiff is suing for her alleged past and future medical expenses, mental anguish and pain.

She is represented by attorney John Parsons of the Beaumont law firm Lindsay, Lindsay & Parsons.

Judge Bob Wortham, 58th District Court, is assigned to the case.
