Driver backed into man's hand, causing injuries, complaint says

A Nederland man claims he suffered severe injuries after a driver struck him while he was attempting to remove a jack from a trailer.

Gerald A. Thibodeaux filed a lawsuit July 26 in Jefferson County District Court against Ecolochem, GE Betz, GE Power and Water and Wayne Harrington.

In his complaint, Thibodeaux claims he was at work at GE Betz and GE Power and was attempting to remove a jack from a trailer when Harrington backed into him in a truck owned by Ecolochem.

Because of the incident, Thibodeaux claims he incurred medical costs, experienced physical pain and mental anguish and lost earnings, according to the complaint. He also suffered damage to his earning capacity, endured disfigurement, suffered physical impairment and incurred medical costs, the suit states.

Thibodeaux blames Harrington for causing his injuries, saying he negligently failed to control his speed, failed to maintain a proper lookout, failed to timely apply his brakes, failed to drive in a safe manner and failed to maintain control of his vehicle.

In his complaint, Thibodeaux seeks actual and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
