Liberty Co. woman sues Wal-Mart after slipping, falling in water

Viki Bell filed suit against Wal-Mart Stores Texas on July 1, 2013 in Liberty County District Court. The defendant removed the case to the Eastern District of Texas, Beaumont Division on Aug. 2. 

The incident occurred on July 7, 2011, as Bell was exiting the Wal-Mart store located in Liberty. As she was leaving the store, she slipped and fell on a puddle of water leaking from the store’s ice machine and mat, according to the lawsuit.

The defendant is accused of negligence for premises liability and negligence for failing to properly correct the condition, failing to warn of the condition or to inspect its store to discover the condition in order to properly correct it or warn Bell about it.

The plaintiff is seeking an award of damages for medical expenses, physical pain and suffering, physical impairment, mental anguish, loss of enjoyment of life, court costs and interest.

Bell is represented by Ryan B. Gross and Ralph P. Manginello of The Manginello Law Firm in Houston. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
