Orange County resident Joel Garza has filed a verified petition to take depositions before suit, seeking to investigate the circumstances of his injury while employed by Kroger Texas.

The petition was filed Aug. 28 in Jefferson County District Court.

According to the petition, on May 28, 2012, while in the employment of Kroger, Garza sustained injuries due to the alleged negligence of the grocer and its employees.

The suit does not state how Garza was injured but does seek the deposition of the Kroger representative with knowledge of stocking procedures.

The deposition of the representative with the most knowledge of a letter alleging Garza’s injury did not occur during the course and scope of his employment is also sought.

Garza is represented by Trenton Bond of the Beaumont firm Portner Bond.

Judge Donald Floyd, 172nd District Court, is assigned to the case.

Case No. E194-680
