Kroger, plaintiff engage discovery in slip-and-fall suit

Kroger Texas and plaintiff Jennifer Fontenot, who slipped and fell while pushing her grocery cart down a store aisle, are locked in discovery.

As previously reported, on Feb. 27 Fontenot filed suit against Kroger Texas and Kenneth Greer in Jefferson County District Court, alleging the defendants left a puddle of liquid unattended on the floor.

Court records show Fontenot filed a certificate of discovery on June 3, showing that she answered and objected to the defendants’ first set of interrogatories and request for production.

The lawsuit alleges that on Aug. 6, 2012, Fontenot was shopping at a Kroger in Beaumont. She was pushing her cart down the alcoholic beverage aisle when she stepped into an unmarked liquid puddle, causing her to slip and fall.

The suit accuses Kroger of negligently failing to warn her of the danger and failing to inspect and maintain the premises.

Greer, the store manager at the time, negligently failed to place caution signs around the puddle and discover the dangerous condition, the suit alleges.

Fontenot is suing for her alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.

Beaumont attorney Trenton Bond of Portner Bond represents her.

Germer Gertz attorney Troy Williams represents the defendants.

Judge Bob Wortham, 58th District Court, is assigned to the case.

Case No. A193-997
