Nurse claims termination due to refusal to lie to patient, files lawsuit

An older nurse has filed an age discrimination lawsuit against her former employer, claiming that she was constructively discharged for refusing to lie to a patient.

Joann Reese filed suit against Silsbee Oaks Health Care on Oct. 21 in the Eastern District of Texas, Beaumont Division.

Reese, who is in her 70s, worked for the defendant for approximately nine years as a licensed vocational nurse. She claims the defendant discriminated, harassed and retaliated against her for her refusal to lie to a patient. 

The defendant is accused of defamation, libel and of Age Discrimination in Employment Act, including the provisions of the Fair Labor Standards Act.

The plaintiff is seeking an award of damages for back pay and front pay, emotional pain and suffering, inconvenience, mental anguish, loss of enjoyment of life, exemplary damages, attorney’s fees and court costs.

Reese is represented by Kenneth W. Lewis and Stephen L. Townsend of Bush Lewis PLLC in Beaumont. A jury trial is requested.

U.S. District Judge Marcia A. Crone is assigned to the case.
