In January, American Express Bank, seeking to collect on a delinquent credit card account, filed suit against Gilbert T. Adams Jr. and his law firm.
As previously reported, the suit was filed Jan. 25 in Jefferson County District Court.
On March 18 the Law Offices of Gilbert T. Adams, answered the suit, asserting a general denial.
The answer further states that defendants Gilbert Adams, also known as Gilbert T. Adams Jr., have been incorrectly sued, as they are not a proper party to the litigation
The firm prays that American Express recover nothing and that it be awarded court costs.
According to the lawsuit, the parties entered into a card member agreement, wherein cash advances were made to Adams’ firm, making them bound to repay the debt.
The suit does not state when the parties entered into the agreement.
“Defendants have failed to repay all of the advances made under the agreement,” the suit states. “The current balance due … is $12,997.96.”
American Express is suing for the balance due and all court costs.
Round Rock attorney Joseph O’Bell of Zwicker & Associates represents the plaintiff.
Adams is representing himself.
Judge Gary Sanderson, 6oth District Court, is assigned to the case.
