Calif. residents claim injuries in alleged auto-pedestrian accident

GALVESTON - Two California residents have filed a lawsuit against an Oklahoma woman in response to an alleged auto-pedestrian accident last year in Galveston.

Alfred Dennis Stout, of Alta Loma, Calif., and his daughter, Kelly Suzanne Hall, assert said accident injured them in recent court papers filed Nov. 8 in Galveston County District Court.

The plaintiffs explain that they were waiting for a ride at the Port of Galveston on Sept. 2, 2012, when Norman, Okla., resident Abigail Marie Price struck Hall.

"The defendant drove over Ms. Hall's foot and caught it," the suit says.

It adds Hall "fell back and was caught and held up" by Stout, who claims he hurt his knee doing so.

According to the original petition, Price did not stop to help the complainants though Stout banged on the car roof.

A police officer reportedly apprehended her later.

Price is faulted for:


  • Failed to keep a proper lookout; and

  • Failed to yield to pedestrians.


Consequently, the plaintiffs seek more than $1 million in damages and a jury trial.

They are represented by attorney Christopher D. Bertini of the Bertini Law Firm PC in Galveston.

Galveston County 405th District Court Judge Michelle Slaughter is presiding over the case.
