MARSHALL - A Louisiana woman has filed a lawsuit against a truck driver claiming she suffered severe injuries when his tractor trailer rear-ended her vehicle.
Jennifer Lee Banes filed suit against Derwin John Alexander on Nov. 13 in the Eastern District of Texas, Marshall Division.
The incident occurred on June 6, 2012, as Banes was operating her 2001 Ford Explorer SUV on S. Eastman Road in Longview.
According to the lawsuit, Banes was stopped behind another vehicle for a red light at Neiman Marcus Parkway when defendant Alexander, who was operating a 2011 Mack 18-wheeler tractor trailer, struck the rear of her vehicle. Banes’ vehicle was forced into the vehicle in front of her.
She claims she suffered severe injuries in the crash.
The defendant is accused of negligence for failing to keep a proper lookout as a person of ordinary prudence would have done, failing to apply the brakes and steer his vehicle to avoid striking Banes, failing to maintain control of his vehicle and for failing to control the speed of his vehicle.
The plaintiff is seeking an award of damages for medical expenses, physical pain and suffering, physical impairment, disfigurement, mental anguish, loss of earning capacity, exemplary damages, interest and court costs.
Banes is represented by Dan Stroup of Dan Stroup PC in Longview and Ralph F. Pelaia Jr. of Ralph F. Pelaia Jr. & Associates in Longview. A jury trial is requested.
