On January 9, 2025, Quinchelle L. Gilbert filed a complaint in the District Court of Harris County against Patricia Ann Phillips and Allstate Fire and Casualty Insurance Company. The case centers around an incident where Gilbert alleges negligence on the part of Phillips, leading to severe consequences.

The lawsuit stems from an incident on February 22, 2024, when Quinchelle L. Gilbert was involved in a collision while picking up her vehicle at St. Luke’s Health — Baylor St. Luke’s Medical Center. According to the complaint, Patricia Ann Phillips struck Gilbert's vehicle with her 2020 Toyota Tundra, causing extensive damage and injuries to Gilbert. The plaintiff claims that Phillips' actions were negligent, including failing to control her speed and maintain proper lane discipline as per Texas Transportation Code §545.351 and §545.060(a). Furthermore, Gilbert accuses Phillips of gross negligence for driving recklessly without regard for safety.

Gilbert also holds Allstate Fire and Casualty Insurance Company accountable under the terms of her insurance policy for uninsured/underinsured motorist benefits due to the damages caused by Phillips' alleged negligence. The plaintiff asserts that she had fulfilled all obligations under her insurance contract but has not received due compensation from Allstate.
