Attorney withdraws from suit over leaky A/C system

Beaumont attorney John Morgan will no longer be represeting Jeffery and Veronica Book, who sued American Air Systems alleging the company installed a leaky unit in their home.

As previously reported, the suit was filed Nov. 17, 2011, in Jefferson County District Court.

Nearly three years later, Morgan, who is no longer with Harris, Duesler & Hatfield, filed an amended motion to withdraw on Oct. 24, stating that the plaintiffs signed a contingent fee power of attorney with the Beaumont law firm and he has no power to prosecute the case.

On Nov. 12, Jefferson County 58th District Judge Bob Wortham granted the motion, court papers say.

According to the lawsuit, the system installed by the defendant was constantly leaking and caused tremendous damage to the couple’s home.

The suit does not state when the unit was installed or if the defendant refused to repair the alleged leaky system.

The plaintiffs accuse the defendant of breach of contract and deceptive trade practices.

They are suing for actual damages and attorney’s fees.
