HOUSTON - In response to her husband's death from injuries purportedly sustained about two months ago while working off the waters of Alabama, Sandra Rogers initiated legal action.
The widow and her two young children with the late Dustin Rogers sued BBC Chartering America, LLC and BBC Chartering USA, LLC in Harris County District Court last month.
Houston federal court received the case on Dec. 23.
Dustin Rogers, 28, was a longshoreman assigned by the defendants to one of their ships last Sept. 7.
He was performing unspecified duties when a crane accident reportedly left him with "horrific" injuries, the suit says.
The decedent then succumbed to said injuries, which court documents attribute to blunt force trauma.
BBC Chartering is faulted for:
- Failing to properly train their employees;
- Failing to provide adequate safety equipment;
- Failing to properly inspect the vessel;
- Failing to warn about the unrepaired conditions of the platform;
- Failing to maintain safe premises;
- Failing to supervise their employees; and
- Providing employees with negligent instructions and orders.
A jury trial is requested.
