A man claims he suffered physical pain after a driver failed to keep a proper lookout and struck his vehicle.
Damon Darnel filed a lawsuit July 18 in the Galveston County District Court against Robert A. Splinter.
In his complaint, Darnel alleges he was driving near the intersection of FM 646 and Interstate 45 in Dickinson on Aug. 11, 2012 when Splinter failed to control his vehicle and struck Darnel’s vehicle.
In addition to his physical pain, Darnel suffered mental anguish, incurred medical costs and lost wages, according to the complaint. He also suffered physical impairment, endured disfigurement and incurred repair costs, the suit states.
Darnel blames Splinter for causing the collision, saying he negligently failed to keep a proper lookout, drove too fast, failed to timely apply his brakes, failed to swerve to cause a collision, failed to swerve to avoid an accident, failed to maintain proper control of the vehicle, failed to give a proper warning of an impending collision and failed to control his speed.
Darnel is seeking a judgment of at least $100,000, plus costs, pre- and post-judgment interest at the legal rate and other relief the court deems just. He is being represented by attorney Mark B. Levin of the Law Office of Mark B. Levin in Houston.
