Worker sues in unpaid overtime pay dispute

A worker is suing a former employer and an insurance agency for unpaid overtime work.

Yondi Nixson filed a lawsuit Nov. 25, in the Sherman Division of the United States Court Eastern District of Texas against Bogdon Insurance Agency LLC, Spectocor Enterprise Services LLC, Joe's Classic Rides LLC and Joseph H. Bogdon, individually over unpaid wages, violating the Fair Labor Standards Act. 

The suit states Nixson worked for Spectocor Enterprise Services LLC from December 2011 through November 2013 as an EKG Tech II. Nixson also worked off-the-clock for the insurance agency and Joe's Classic Rides LLC.

Nixson claims she regularly worked overtime and was not paid one-and-a-half times the rate of pay, according to the suit.

Nixson also alleges she and her father have been threatened and intimidated in retaliation for her seeking her overtime pay, the complaint states.

Nixson is seeking an award of liquidated damages in an equal amount of the unpaid overtime pay and in an amount equal to damages she has suffered as a result of defendant's actions, plus court costs and pre-judgment and post-judgment interest at the highest rates allowed.

She is being represented by Douglas Welmaker of Dunham & Jones PC.
