A man is suing a large grocery store chain claiming he fell while shopping.
Arnold Pell filed a petition and request for disclosure on Feb. 3 in the Galveston County District Court against Kroger Texas LP.
According to the suit, on May 20, 2011, Pell was grocery shopping and went to retrieve an item from the top shelf of a freezer, while a Kroger employee held the freezer door open for him.
Pell claims that he climbed to reach the item and while doing so, slipped and fell on his knee, causing injuries.
Pell is seeking damages over the jurisdictional limit.
