Three property owners sue fourth over sale

Three property owners are suing the fourth owner claiming he hasn’t lived up to the group’s agreement to maintain and eventually sell the property. 

Katherine Belk Parent, Melvin Douglas Belk and Judy Belk Kuykendall filed a lawsuit Dec. 18 in the Jefferson County District Court against James Dewit Belk, citing breach of contract.

The lawsuit states the property in Port Neches is owned by the four with James Belk living on the property in order to show it and assist in selling it. The four were to split the proceeds, according to the complaint.

The Katherine, Melvin and Judy allege that James Belk has let the property fall into disrepair and there are various strangers in and on the property, the complaint said.

The three property owners are asking the court to let them proceed with the sale and to issue a temporary restraining order against James Belk preventing him from interfering.

The three property owners are being represented by Gordon Friesz of McPherson, Hughes, Bradley, Wimberley, Steele & Chatelain.
