Wal-Mart employee claims work area stuffed with clothes caused fall from ladder

Yolanda Meneses is suing Wal-Mart over injuries she allegedly sustained at the workplace.

Meneses filed her suit Feb. 12 in the Galveston County District Court naming Wal-Mart as the defendant. 

Meneses claims she was assigned to the task of hanging clothes in the storage area of Wal-Mart. In order for her to hang the clothes, Meneses had to climb a ladder.

However, Meneses claims Wal-Mart fit so much clothing into the space it was impossible to unfold the ladder for proper stability. Instead, employees allegedly would just lean the ladder against the racks of clothing.

Meneses claims when she was climbing the ladder one day the ladder moved, causing her to fall backwards injuring her back and knee.

Meneses apparently does not qualify for workers' compensation so she brought this suit to recover for her workplace injury. She claims Wal-Mart was negligent in placing the clothes so close together and requiring employees to lean the ladder on the clothing racks.

Meneses is seeking an undisclosed amount in damages and is being represented by attorney Brian H. Crockett of Newton Jones & Spaeth in Houston.
