Donnie Mcrae Enterprizes Inc. is suing Dr. Shanaz Khan, doing business as Eggerton Clinic, for over more than $200,000 in unpaid rent. DME filed its suit Feb. 12 in the Galveston District Court.
DME claims it owns a piece of real estate at 347 E. Parkwood Ave. in Friendswood. The property is commercial office space and was rented to Khan in 2008. Khan allegedly agreed to pay $6,850 per month and provided for a late payment of $25 on the first day and $20 for each day of the month in which the rent was unpaid.
DME claims in November 2011, Khan unilaterally told DME she was going to start paying reduced rent, according to the lawsuit. DME claims they tried to resolve this issue with Khan for several months, but she was unresponsive but continues to pay only half the rent, the suit states.
DME claims they rented part of the space to accommodate Khan and reduce her payments, but never agreed to waive the amounts she owed in late and unpaid rent. DME insists Khan has breached the lease agreement and owes more than $200,000 in unpaid rent and late fees, according to the complaint.
DME is seeking more than $200,000 in damages and is being represented by attorney Craig W. Saunders of Barlow & Jones LLP.
