A Galveston county resident is suing after sustaining injury in a collision and after failing to receive payment under an underinsured insurance policy.
James Williams filed a lawsuit Feb. 18 in the Galveston County District Court against Donald Lee Hammill and Hanover American Insurance Co., citing negligence, unfair settlement practices, breach of good faith and fair dealing and unreasonable delay in payment of claim.
The complaint states, on Feb. 22, 2012, Williams sustained serious injuries in a motor vehicle collision due to Hammill's negligence.
At the time of the accident, the plaintiff was protected by insurance provided by Hanover American Insurance, including underinsured motorist protection, according to the complaint.
The plaintiff states Hammill was an underinsured motorist and Hanover American Insurance has failed to make payments due under his insurance policy.
Williams is seeking declaratory and injunctive relief, damages within the jurisdictional limits of the Court, including exemplary damages, statutory damages, interest, fees and costs.
He is being represented in the case by attorney Thomas M. DeWitt of DeWitt Law Firm.
