Kingwood man claims tooth cracked eating po-boy, sues restaurant

A Galveston restaurant is being sued after a customer claims he was injured when he bit into a sandwich. 


Adil Mistry filed a lawsuit Feb. 21 in the Galveston County District Court against Galveston Restaurant Group Inc., doing business as Little Daddy's Gumbo Bar, citing strict product liability, negligence, res ipsa loquitur, breach of implied warranty and vicarious liability.

According to the complaint, on May 25, 2012, Mistry visited the defendant's restaurant at 2107 Post Office St. in Galveston.

The plaintiff states he ordered an oyster po-boy and when he bit into the sandwich, he claims he cracked a molar on a hard object. The defendant has not reimbursed the plaintiff for the dental care that was required after the incident, according to the complaint.

Mistry is seeking damages less than $100,000.

The plaintiff is being represented in the case by attorney Jared B. Ynigez of the Law Office of Jared B. Ynigez PLLC.
